لســـــانيــــات قـــانـــونيــــة: التســاوق بـين اللســانيــات والقـــانـــون Legal Linguistics: Correspondence between linguistics and law

تكشف الدراسة عن دور المهارات اللسانية في المجالات القانونية، وتبين أن الخطاب القانوني من ألصق العلوم باللسانيات، والحاجة ماسة إلى تلك المهارات في جميع مراحل العمل القانوني ابتداءً من التشريع وسن القوانين، ومرورًا بأعمال المحاماة وتحقيقات النيابة وتسبيب الأحكام وتأليف الكتب القانونية، وشرحها وعند الصياغة الوقائية والبيانية، وبالأروقة القضائية، وفي مراكز الشرط وأماكن التحقيقات عامة؛ إن تأسيسًا أو تطبيقا أو تفسيرًا وتأويلاً.
ولا تقف المهارات اللسانية عند حد الإلمام بصواب الكلمة وصحة التراكيب بل تتجاوزه إلى القدرة على دقة الصياغة، وحسن البيان وتحقيقا لتأثير والإقناع بالحجج بين أطراف التواصل، والكشف عن المستور بين السطور بالمقاربات التي تساعد على ذلك، والعجز في امتلاك هذه المهارات يعرقل تحقيق العدالة الناجزة.
The study reveals the role of linguistic skills in the legal field. It shows that legal discourse is one of the closest sciences to linguistics. There is an urgent need for these skills in all stages of legal work, such as legislation, enactment of laws, advocacy, prosecution investigations, causation of judgments, authoring legal books, explaining them, protective and declarative wording, judicial facilities, police stations, and places of general investigation in terms of foundation, application, explanation, or interpretation.
Linguistic skills do not include only the knowledge level of the correct wording and the correctness of structures, but rather go beyond that to the ability to accurately formulate good drafting and achieve influence and persuasion with arguments among the parties of communication. They also reveal what is hidden in the texts, with approaches that help achieve that. The inability to possess these skills hinders the achievement of complete justice.
